Frequently Asked Questions about Criminal Defense

Q: Is unsuccessfully attempting to commit a crime an offense?

A: It may be. It depends on the circumstances and on the law of the jurisdiction. A person who intends to commit a particular crime and takes a substantial step toward perpetrating it, but fails to actually complete it may be guilty of the separate crime of attempt. Generally an act that is extremely remote from the completed crime, such as early preparation, will not be significant enough to constitute criminal attempt.

Q: What is the role of the grand jury?

A: The US Constitution requires that the federal government convene a grand jury to decide whether accusing a person of a major crime is appropriate. In a practice originating in England, the grand jury reviews the evidence and may hear testimony in deciding whether to indict someone, but the grand jury makes no decision about guilt or innocence. Another traditional purpose of the grand jury is to serve as a buffer between an overzealous prosecutor and the accused. All states also use the grand jury system to some extent.

Since 1992, the likelihood of an arrest leading to a conviction has generally risen. Although some defendants think that they can "beat the system" on their own, having an experienced criminal defense attorney on your side is the best way to prevent becoming another statistic.

Colorado Springs Felony Criminal Defense Lawyer

Whether you’ve been charged with a minor misdemeanor or a serious felony, you need solid legal representation to protect your rights under the law.

Without adequate counsel, you could face severe consequences. If you're convicted of a motor vehicle charge, for instance, you can lose your driver's license. If you’re convicted of a more serious felony, such as assault and battery, grand theft, or manslaughter, you may have to pay astronomical fees and serve a mandatory jail sentence. With a qualified, sober minded criminal defense attorney on your side, however, you can fight for a reduced sentence, shorten your trial time, and even potentially get the charges against you dropped altogether.

Criminal Defense - An Overview

Our criminal-justice system can be overwhelming and frightening. The United States' incarceration rate is much higher than that of other industrialized countries. Prison sentences are getting longer and more frequent. If you face the possibility of being accused of a crime, contact an experienced Colorado criminal-defense lawyer as early in the process as possible, preferably even before questioning or investigation. A skilled attorney can fight for your legal and constitutional rights. Remember that if you cannot afford to hire a lawyer, the government may have to provide one for you.

Definition of Criminal Liability

In the Western tradition of jurisprudence, liability is assessed according to two categories:

Mens rea – technically translated a “guilty mind,” this category describes the intent of a person to commit a criminal violation.

Actus reus – technically translated as “guilty act," this category describes actions taken by a defendant.

Constitutional Rights of Criminal Defendants

During the founding days of the United States, legislators established inalienable rights for criminal defendants. They even wrote these rights into the United States Constitution and bolstered them with the passage of the first ten Amendments to the Constitution, often referred to as the “Bill of Rights.” The Supreme Court later passed the fourteenth amendment, which gave defendants in state trials rights similar to the due process protections already afforded to federal defendants.

How Crimes Are Classified

Crimes typically fall into three major categories – felonies, misdemeanors, and minor charges. This “sliding scale” helps judges and juries assess options for rehabilitation and justice. In general, the more serious the charge against you, the more severe the punishment you will endure if convicted.

Capital Punishment

Although governments the world over have been moving to eliminate or reduce the use of the death penalty, the United States still considers this form of punishment legal. 37 states as well as the U.S. federal government allow for capital punishment in certain cases; Oklahoma, Texas, Missouri, Virginia, and Florida lead the nation in executions.
